Welcome to supplygopher.com (the "Site"). Please review these terms, which govern your use of the Site (the "Terms of Use"). Your continued use of the Site means you agree to follow and be bound by these Terms of Use.

As we continue to develop the Site, we may modify or update these Terms of Use from time to time. Your use of the Site after a change means you agree to the Terms of Use as changed, so please check this page from time to time.

Prices are shown in US dollars and do not include sales tax. Processing times, shipping, freight delivery, damaged or missing items, returns, and refunds are governed by our Shipping & Returns policy, which is part of these terms. Material that is not in its original, unopened manufacturer packaging, and any installed item, cannot be returned. This is the policy of the manufacturer.

Products are covered by the manufacturer's warranty. The Company makes no additional warranty on products.

The Site and all of its contents are provided on an "as is" basis without warranties of any kind, express or implied, including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose. The Company does not warrant that your use of the Site will be uninterrupted or error free, or that the Site or its server are free of viruses or other harmful elements. Your use of the Site is at your sole risk. You are responsible for all costs of servicing or repairing any equipment you use in connection with the Site.

Although the Company works to provide accurate information, it does not warrant or make any representation about the accuracy or reliability of information on the Site. Neither the Company nor its related entities, vendors, or content providers shall be liable to any person or entity for any direct or indirect loss, damage (whether actual, consequential, punitive, special, or otherwise), injury, claim, or liability of any kind based on or resulting from your use of or inability to use the Site, or any information or materials provided on it. The Company is not liable for any defamatory, offensive, or illegal conduct of any user. If you are dissatisfied with the Site or with these Terms of Use, your sole and exclusive remedy is to stop using the Site.

You agree to indemnify, defend, and hold harmless the Company and its shareholders, officers, directors, employees, agents, distributors, vendors, and related entities from all third-party claims, demands, liabilities, costs, or expenses, including reasonable attorney's fees, arising from your breach of these Terms of Use.

These Terms of Use are an agreement that stays in effect until it is ended by you or the Company. You may end it at any time by emailing info@supplygopher.com. The Company may end it at any time, immediately and without notice, and deny you access to the Site if, in the Company's sole discretion, you fail to comply with any of these terms. When the agreement ends, you must promptly destroy all materials downloaded or otherwise obtained from the Site, and all copies. These Terms of Use are the entire agreement between you and the Company on the subjects they cover.

The terms of this agreement are severable. If any term is found invalid or unenforceable, it will be read consistent with applicable law as nearly as possible to reflect the original intent of the parties, and the remaining terms stay in full force and effect. If either party ends this agreement, sections 1, 2, 6, 7, 8, and 9 survive.

This agreement is governed by the laws of the State of California, without regard to conflict of law provisions. Any dispute arising under this agreement shall be resolved exclusively by the state and federal courts located in San Diego County, California.
